Family Dispute Over a Will

Case Study Caption

About This Case

We were approached by a brother and sister who found themselves at odds over the interpretation of their late father's Will. The brother contended that a Supreme Court judgment from an unrelated case should override the provisions of the Will.
After multiple rounds of discussions and careful review, we provided a formal legal opinion clarifying that such judgments only take precedence where the Will is deemed invalid. In this case, the Will was found to be valid and enforceable.

Challenge

  • Encouraging both siblings to come together and engage in constructive dialogue
  • Navigating emotionally charged conversations around family and inheritance
  • Addressing and resolving the dissolution of the father's Hindu Undivided Family (HUF)

Our Approach

1. Strategic Planning

We initiated the process with a thorough assessment of the facts and held periodic discussions with both parties to understand their concerns.

2. Formal Legal Opinion

We issued a detailed legal opinion affirming the validity and enforceability of the father’s Will, and clarifying its precedence in the matter.

3. Dissolution of HUF

Proactively, the HUF was dissolved during the father’s lifetime, thereby helping avoid potential legal disputes amongst heirs in the future.
